Winter Weather – PA Law Requires Removal of Snow and Ice
Winter is coming and unfortunately so are the weather related concerns that affect transportation. Snow and ice on the roof of moving vehicles is a safety hazard that can lead to injuries, citations, and fines. Contractors should be aware of Pennsylvania laws requiring the removal of snow and ice from the roof of moving vehicles. “Christine’s Law” was enacted in 2022 as a result of Christine Lambert’s death from dislodged ice that fell like a projectile from a moving vehicle in 2005. Pursuant to 75 Pa.C.S.A §3721, motorists must, within 24 hours of the stoppage of the falling of snow or ice, make reasonable efforts to clear accumulated ice or snow from the vehicle including the hood, trunk and roof.
Motorists can be stopped by police if the officer believes the snow or ice on a moving vehicle may pose a threat. The police can also issues a fine of $50.00. Additionally, if ice or snow does become dislodged and strikes someone or something, the driver can face a fine up to $1,500.00 per incident, in addition be being liable for any injuries or damages that may arise from failure to clear ice and snow from a moving vehicle.
