And Another Thing...

With the approach of yet another winter storm for our area, clients are concerned for their safety, along with their responsibility when it comes to removing ice and snow buildup on the tops of vehicles.

The PA statue is 75 P.S. 3270 and it states that:

 “When snow or ice is dislodged or falls from a moving vehicle and strikes another vehicle or pedestrian causing death or serious bodily injury, the operator of the vehicle from which the snow or ice is dislodged or falls shall be subject to a fine of not less than $200 nor more than $1,000 for each offense.”

Note that the violation occurs only if the falling snow/ice causes “…death or serious bodily injury…”.  So, if snow/ice falls from a moving vehicle but only causes property damage to another vehicle but does not cause “death or serious injury” there is no violation. 

With that said, we would still recommend taking steps and making an effort to remove the ice and snow from the tops of your vehicles, or used cover parking when possible.  Also consider engaging your bad weather defensive driving techniques such as providing plenty of space between you and other vehicles, and only going out if truly necessary.  After all, much like the weather, predicting where, when and what would happen if a mound of ice or snow does in fact fall off your vehicle is not an exact science.
